These Terms of Use (“Terms”) govern your access to and use of the KindredCare platform, website, mobile application, and related services (collectively, the “Platform”). By using KindredCare, you agree to these Terms. Please read them carefully.

1. Overview

KindredCare is an AI-powered caregiving platform designed to connect seniors, families, long-term care (LTC) facilities, and caregivers across Canada. The Platform provides intelligent search, background verification, visit tracking, and payment processing tools that make caregiving more efficient, transparent, and secure.

2. User Eligibility

KindredCare services are available to:

  • Caregivers, including Personal Support Workers (PSWs), nursing students, and licensed nurses (LPNs, RNs, NPs), who wish to offer caregiving services independently or through LTC facilities.
  • Seniors, family members, or their representatives seeking verified caregivers.
  • LTC operators using KindredCare to manage caregiver recruitment and assignments.

By creating an account, you confirm that you are legally eligible to enter into this agreement under applicable Canadian laws.

3. Account Registration and Verification

All users must complete KindredCare’s eKYC (Electronic Know Your Customer) process.

Verification includes, but is not limited to:

  • Facial and document verification
  • Date of birth and address confirmation
  • Risk and AML (Anti-Money Laundering) screening
  • Optional video verification for higher trust scoring

Users must provide accurate information during registration. Submitting false or misleading data may result in account suspension or termination.

4. Platform Features

KindredCare provides the following key features:

  • Advanced Intelligent Search: Find caregivers based on skills, experience, and location.
  • Automated Background Checks: Document recognition and verification using OCR and third-party KYC software.
  • Electronic Visit Verification (EVV): Track caregiver attendance, time, and service delivery.
  • Automated Payment Processing: Secure invoicing and payments through supported providers (e.g., credit cards, PayPal, Stripe, Square).
  • KindredCare Trust Score: Algorithm-based rating built from user feedback, references, and performance.

5. Payments and Fees

  • Families and seniors agree to pay caregivers directly through the Platform’s integrated payment system.
  • KindredCare charges a 7.5% commission fee for each completed caregiving task.
  • LTC operators subscribe via a monthly plan of approximately $240.
  • KindredCare does not collect GST/HST on personal care services, which are exempt under Canadian tax law.
  • Refunds and chargebacks are governed by the respective payment provider’s policy.

6. User Responsibilities

Users agree to:

  • Use KindredCare only for lawful purposes.
  • Maintain accurate, updated personal and professional information.
  • Respect privacy and confidentiality of other users.
  • Abide by all relevant labour and tax reporting obligations, including annual income reporting for caregivers.

Caregivers are responsible for maintaining appropriate professional licenses and certifications if required by their province or employer.

7. Trust, Ratings, and Reviews

After each service, both caregivers and clients may leave ratings and feedback.

These reviews contribute to the KindredCare Trust Score, influencing search rankings and visibility.

Users agree to provide honest and constructive feedback. Manipulation of reviews or ratings is prohibited.

8. Data Protection and Privacy

All user data is protected using end-to-end encryption.

KindredCare’s verification process follows Canadian privacy and security standards.

Personal data is shared only as required for onboarding, payments, or verification.

By using KindredCare, you consent to the collection, processing, and storage of your data for service delivery and regulatory compliance.

9. Regulatory Compliance

KindredCare operates in compliance with Canadian labour codes and provincial regulations.

The platform supports employers and caregivers by generating earnings statements and enabling transparent wage reporting for tax purposes.

10. Service Availability

KindredCare strives to maintain high service uptime as defined in its Service Level Agreement (SLA).

However, technical disruptions may occur. The company will take reasonable measures to restore functionality promptly.

11. Limitations of Liability

KindredCare acts as a digital intermediary.

We do not employ caregivers or directly provide caregiving services.

Users are responsible for verifying the suitability of each engagement.

KindredCare is not liable for any injury, loss, or dispute arising from direct interactions between users.

12. Termination of Use

KindredCare reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, unsafe, or non-compliant behaviour.

13. Modifications

KindredCare may update these Terms periodically to reflect changes in technology, services, or legal requirements. Continued use of the Platform constitutes acceptance of the revised Terms.
